Website & Online Shop: Infinite Intimate

The website and online shop (https://infiniteintimate.art/sklep) are owned by Margo Kido, operating as a sole trader under the business name Margo Kido, registered in the Central Registration and Information on Business, based at ul. Ajschylosa 15, 60‑461 Poznań, Poland, Tax ID (NIP) 9720855504.

§1 Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

Buyer – a natural person, legal person or organizational unit without legal personality;

Civil Code – the Act of 23 April 1964, Civil Code;

Consumer – a natural person purchasing in the Shop outside the scope of their business or professional activity (Article 221 of the Civil Code);

Terms – these Terms & Conditions, available at the Shop’s website;

Shop – the online shop operating at https://infiniteintimate.art/sklep/;

SellerMargo Kido, sole trader based at ul. Ajschylosa 15, 60‑461 Poznań, registered with NIP 9720855504.

§2 General Provisions

1. The Seller enables the Buyer to conclude contracts for physical products, online courses, and other electronic products available in the Shop.

2. These Terms regulate the use of the Shop, as well as the rights and obligations of the Seller and Buyers.

3. To use the Shop, no special technical requirements are needed—just Internet access, a standard operating system, a web browser, and an active e-mail address.

4. Buyers cannot purchase anonymously or under a pseudonym.

5. Buyers must not submit any unlawful content through the Shop.

6. All prices displayed in the Shop are gross prices (inclusive of VAT).

§3 Electronic Services

1. The Seller provides electronic services through the Shop:

enabling place orders leading to contracts,

optional account creation and management,

newsletter subscription and email delivery of news and promotions.

2. Services are free; paid services are purchase orders and digital content delivery contracts.

3. The Seller implements technical and organizational measures for the security of transmitted data.

4. The Seller ensures proper functioning of the Shop; Buyers should report any issues via infinite.intimate.art@gmail.com. Complaints are addressed within 14 days.

§4 Placing an Order

1. Buyers may place orders as registered users or guests.

2. Orders are placed via a form after adding items to the cart, selecting delivery and payment methods, and accepting the Terms.

3. After confirming payment, the Buyer is redirected to a confirmation page, and the contract is concluded. A confirmation email is sent.

4. The contract type depends on items:

sale contract for physical goods and consultations,

digital content contract for online courses and electronic products.

5. Buyers must provide accurate personal data. The Seller may suspend orders if the data is false or questionable, contacting the Buyer for clarification.

§5 Delivery & Payment

1. Payment and delivery options are described in the Shop and during checkout.

2. Delivery costs are borne by the Buyer unless stated otherwise.

3. Electronic payments are handled via:

PayPro SA (Przelewy24),

PayPal (Europe) S.à r.l. et Cie, S.C.A.

Credit cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

§6 Physical Products

1. Orders for physical items are fulfilled by shipping to the Buyer’s address.

2. Orders are dispatched within 72 hours unless stated otherwise.

3. The order is considered completed when dispatched; delivery times depend on selected shipping method.

§7 In‑Person Workshops

1. Orders for workshops are fulfilled by sending an electronic ticket via email.

2. Tickets are dispatched within 72 hours unless otherwise stated.

3. The contract is completed upon ticket delivery by email.

§8 Online Courses

1. Orders for online courses are fulfilled by email instruction to access the course.

2. Access is provided via a dedicated course platform. Account creation occurs automatically.

3. Digital delivery is deemed complete upon first login.

4. Access may be limited per course description. If unlimited, the Seller may withdraw access with one month’s notice, allowing Buyers to download materials before expiration.

5. Course use must comply with the law, these Terms, and good practices. Buyers must not share access or content. Violation allows the Seller to block access.

6. Courses may have separate pages, but access is always purchased via the Shop.

§9 Electronic Products

1. Electronic products (e‑books, webinars, audiobooks) are fulfilled via email containing download instructions.

2. Delivery is considered completed when the email is sent.

§10 Intellectual Property

1. All content in the Shop, electronic products, courses, and materials are protected by copyright, owned by the Seller.

2. Unauthorized distribution may result in civil or criminal liability.

§11 Consumer Right of Withdrawal

1. Consumers have a 14-day right to withdraw from distance contracts:

from product receipt for sales,

from contract agreement for digital content.

2. This right does not apply to digital content when delivery has started with explicit consent and withdrawal rights have been waived.

3. Tickets for events are not refundable unless the event is canceled. They are non-transferable.

4. Withdrawal occurs upon sending a clear withdrawal declaration before the 14-day deadline, using any communication form.

5. Consumers may use a withdrawal form, but it is not mandatory.

6. To meet the deadline, the withdrawal notification is sufficient.

7. Consumers must return the product within 14 days. Return shipping costs are borne by the Consumer.

8. The Seller will refund all payments, including cheapest delivery cost, within 14 days using the same payment method, unless otherwise agreed. No fees will apply. If the Seller did not offer collection, refund may await item return or proof of shipment.

9. Consumers may incur liability for diminished value from excessive use.

§12 Liability for Defects

1. The Seller must deliver defect-free products and digital content.

2. Liability arises under statutory warranty for defects.

3. Buyers must notify defects and specify their claims.

4. A complaint form is optional. Communication via email or mail is allowed.

5. Seller will respond within 14 days of receiving the complaint.

§13 Personal Data & Cookies

1. The Seller is the data controller for Buyer data, processed to fulfill orders, manage accounts, and manage claims.

§14 Alternative Dispute Resolution

1. The Seller agrees to mediation for disputes from these contracts.

2. Consumers may use out-of-court mechanisms:

consumer arbitration boards,

provincial inspector for Trade Inspection mediation,

municipal consumer rights advocates,

§15 Final Provisions

1. The Seller reserves the right to change offers, promotions, or prices without affecting acquired rights.

2. Disputes are governed by Polish courts at the Seller’s location, except for Consumers subject to general jurisdiction rules.

3. The Seller may amend the Terms. Contracts before amendment remain governed by the previous Terms.

4. These Terms are effective from 1 May 2020.
